Cancellation & Attendance Policy
The Peach Room Wellness Collective Inc. ( the “Studio”)
This Cancellation & Attendance Policy (this “Policy”) forms part of each Membership Agreement, class pack purchase, drop-in purchase, workshop registration, private session booking and any other booking or participation in Services with the Studio. Capitalized terms not defined in this Policy have the meanings given in the applicable governing agreement or terms.
1. Application
This Policy applies to all bookings made through the Studio’s Booking System or otherwise accepted by the Studio. By booking, attending or remaining on a waitlist for any Service, the client agrees to this Policy.
2. Operational Discretion
The Studio may change schedules, substitute instructors or contractors, alter class formats or durations, reduce class caps, reassign rooms or equipment, cancel Services, close waitlists, restrict booking privileges, or otherwise make operational decisions at any time and without liability, acting reasonably in the ordinary course having regard to its business, staffing, health and safety, and service levels.
3. Waitlists
Unless the Studio states otherwise in writing, waitlists close sixty (60) minutes before the scheduled start time of the applicable class. If a client is moved from the waitlist into a class, the booking becomes subject to this Policy immediately. The Studio may at any time change waitlist windows, auto-enrolment settings, notification settings or cut-offs.
4. Member Cancellations
For recurring Membership bookings, cancellations must be made at least eight (8) hours before the scheduled class start time. A cancellation made after that deadline is a late cancellation.
5. Class Pack and Drop-In Cancellations
For class packs, drop-ins and other non-membership class purchases, cancellations must be made at least twelve (12) hours before the scheduled class start time. A cancellation made after that deadline is a late cancellation.
6. Late Cancellation Consequences
Unless the Studio expressly waives the consequence in writing or in the Booking System, a late cancellation will result in:
a late cancellation fee of $15.00; and
the forfeiture of the Class Credit, session entitlement or booking value used to reserve the class.
The Studio may in its discretion set different cancellation fees or credit consequences for certain premium offerings, guest events, workshops, series, private sessions or limited-capacity Services, provided those are communicated at or before booking.
7. No-Shows
If a client does not attend a booked Service, arrives too late to be admitted in accordance with Studio rules, or otherwise fails to take the booked Service without a timely cancellation, the client will be treated as a no-show. Unless the Studio expressly agrees otherwise, a no-show results in:
a $15.00 no-show fee; and
forfeiture of the applicable Class Credit, session entitlement or booking value.
8. Repeated Late Cancellations or No-Shows
Where a client repeatedly late-cancels, no-shows, manipulates waitlists, books speculatively without attending, or otherwise interferes with fair access to classes, the Studio may impose booking restrictions, shorten booking windows, require prepayment, require additional notice periods for certain bookings, suspend online booking privileges, or terminate the client’s access to some or all Services.
9. Credits and Refunds
Subject to any applicable law that cannot be excluded, missed classes, late cancellations, no-shows and expired credits are not refundable. Where a client cancels in time and is otherwise eligible for a return of value, the Studio may return the value as an account credit unless the governing terms for the applicable Service provide otherwise or the Studio elects, in its discretion, to refund to the original payment method.
10. Membership Billing, Cancellation and Holds
Membership billing, early termination, change requests and membership holds are governed by the applicable Membership Agreement. Without limiting that agreement:
memberships require a minimum twelve (12) week commitment unless otherwise stated in writing;
memberships are not cancellable retroactively;
no refunds are issued for unused time or unused credits; and
outstanding fees must be paid before a cancellation or downgrade becomes effective.
membership holds may be permitted after the initial twelve (12) week commitment period, subject to the Studio’s approval and applicable terms, including advance notice requirements, minimum hold durations, and annual limits as outlined in the Membership Agreement.
11. Workshops, Special Events and Private Sessions
Unless the Studio states otherwise at booking, workshops, special events, series and private or semi-private sessions must be cancelled at least seven (7) days before the scheduled start time to receive a refund to the original payment method or an account credit, at the Studio’s discretion. Cancellations inside seven (7) days are non-refundable. No-shows are non-refundable and do not generate credits.
12. Studio Cancellations
If the Studio cancels a Service, the Studio’s sole obligation is to restore the applicable credit to the client account, issue a replacement credit, reschedule the Service, or refund the amount paid for the cancelled Service, at the Studio’s election unless otherwise required by law. The Studio is not responsible for indirect or consequential costs or losses arising from a cancellation, including transportation, childcare, lost time, third-party bookings or other incidental expenses.
13. Health and Safety Closures; Force Majeure
The Studio may close or modify operations due to illness, public health requirements, weather, utilities failure, equipment failure, landlord issues, casualty, labour issues, staffing shortages, contractor unavailability, emergency repairs, acts of God, government action or any other event beyond the Studio’s reasonable control. In such circumstances, the Studio may suspend Services, reschedule bookings, offer credits, extend validity periods, or take other commercially reasonable steps without being in breach.
14. Policy Updates
The Studio may amend this Policy, including applicable fees, cancellation windows, waitlist rules and attendance consequences, on reasonable notice where practicable. Continued use of the Services after an amendment takes effect constitutes acceptance of the revised Policy.
